LegCo issues written warning to Judy Chan over wrong-way driving incident

The Legislative Council's Supervisory Committee issued a written warning to lawmaker Judy Chan over her wrong-way driving incident.

The incident unfolded on January 23rd when New People Party lawmaker Judy Chan was seen driving against the flow of traffic on Jaffe Road in Wan Chai.

The 45-year-old apologised to the public on the night of the incident and again the following day.

She also reached out to the police to assist with investigations.

A month later, the witness who filmed the incident lodged a complaint with the Legislative Council, alleging that Chan had breached the legislature's Code of Conduct and failed to comply with Hong Kong law, causing disappointment to the public.

The Supervisory Committee then launched a probe.

Chan later apologised for causing unnecessary controversy.

Having brought a negative impact on LegCo's image, she says she accepts all consequences.

The Supervisory Committee says driving on the wrong side of the road is a criminal traffic offence that could lead to serious results.

There is no doubt Chan's offence fell short of society's expectations of lawmakers.

Considering all the findings, the committee accepted Chan made an erroneous judgment out of convenience, describing the act as reckless.

But the committee found the act did not involve personal integrity issue or abuse of power. They also noted this was Chan's first careless driving offence in 22 years of driving.

The court earlier fined her 2,000 dollars and suspended her licence for one month showing the case was relatively minor and straightforward.

The committee said Chan had tried her best to remedy the matter afterwards, and accepted she had shown remorse with efforts to minimise impacts on the legislature.

The committee, therefore, unanimously concluded that the misconduct "did not reach a serious level."

Noting this was her first offence, the committee decided to issue a written warning.

Speaking to the press, Judy Chan apologises and says she sincerely accepts the report made by the investigation committee. This marks the first time a lawmaker has been punished since the current term's Code of Conduct for Members came into effect.

LegCo President Starry Lee says the punishment is appropriate and carries sufficient deterrent effect as a formal written warning is already a very serious warning.
